FULL PRIVACY NOTICE

 

In accordance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties, its Regulations, and the Privacy Notice Guidelines, we hereby inform you (the “Data Subject”) of our privacy notice (the “Privacy Notice”), which shall apply to you as a customer, user, independent service provider, or employee of CORPORATIVO AGROINDUSTRIAL ALTEX, S.A. DE C.V., as well as all of its subsidiaries (“ALTEX”).

This Privacy Notice applies to the information collected by ALTEX through the Website, emails, and other possible communication channels, such as social media, smartphones, third-party websites related to ALTEX, in-person surveys conducted at proprietary or third-party events, among others.

Pursuant to applicable legislation, the Data Subject agrees that the processing of their personal data shall be carried out in accordance with this Privacy Notice.

(A) Identity and Address

ALTEX, with address at Av. Paseo de las Palmas 820, first floor, Colonia Lomas de Chapultepec V Sección, Miguel Hidalgo Borough, ZIP Code 11000, Mexico City, Mexico, shall be responsible for processing the personal data provided to us in accordance with this Privacy Notice.

(B) Personal Data to Be Processed

The data provided by the Data Subject to be processed under the corresponding section of this Privacy Notice shall include:
(i) first name(s), paternal surname, and maternal surname;
(ii) address;
(iii) mobile phone number; and
(iv) email address.

The Data Subject undertakes that the data provided to ALTEX is truthful, complete, and accurate. Any false, incomplete, or inaccurate information shall be the sole responsibility of the Data Subject.

(C) Purposes of Data Processing

The purposes for processing personal data are as follows:

The data provided to us shall be used to:

(i) provide the services and products requested;
(ii) issue invoices and payment confirmations;
(iii) periodically send communications such as promotions or information about new products via email; and
(iv) send certain mandatory service communications, such as welcome letters, payment reminders, information regarding technical or commercial matters, and security notices.

(D) Mechanism to Express Refusal

The mechanisms through which the Data Subject may express refusal for the processing of their personal data for purposes that are neither necessary nor gave rise to the legal relationship with the responsible party are not applicable, since there are currently no secondary or ancillary purposes.

However, ALTEX may process personal data for marketing, advertising, or commercial prospecting purposes. If you do not wish your personal data to be processed for these purposes, please notify our Personal Data Protection Department.

(E) Collection and Transfer of Data

ALTEX collects information from various sections of the Website and through commercial relationships. The information requested varies and is stored in separate databases. The information provided must be truthful and complete. The Data Subject shall at all times be responsible for the information provided, and ALTEX shall under no circumstances be responsible for its accuracy.

You may visit the ALTEX Website as many times as you wish without revealing personal information. However, when you visit our Website, we may collect and store information about your device and Internet connection, statistics regarding visited pages, traffic to and from the Company, advertising data, IP address, standard web log information, and information from other companies, such as demographic information and browsing data.

To actively participate on the ALTEX Website, we require certain personal information. Once you provide such information, you cease to be an anonymous user. By providing your personal information, you consent to its transfer and storage on our servers.

When registering on the ALTEX Website, we will collect the following necessary information: email address, first and last name, date of birth, password; transaction information based on your activities with ALTEX, shipping, payment, and information related to purchases or deliveries, correspondence sent to ALTEX, and mailing address.

(F) Means and Procedure to Exercise ARCO Rights

The personal data provided by the Data Subject shall form part of a file containing their profile. The Data Subject may access or modify their profile at any time by sending an email to mmena@grupoaltex.com.

If the Data Subject wishes to exercise their rights of access, rectification, cancellation, or opposition (“ARCO Rights”) regarding the processing of their personal data, or wishes to revoke their consent, they must submit a written request by postal mail or electronically directly to ALTEX, addressed to Mr. Miguel Mena Bustamante at mmena@grupoaltex.com.

If choosing postal mail, requests must be sent to the following address:

The request to exercise ARCO Rights must contain and be accompanied by the following:

(i) the Data Subject’s name, address and/or email address, and any other means to communicate the response to the request;
(ii) official documents proving identity or, where applicable, legal representation;
(iii) a clear and precise description of the data regarding which any of the aforementioned rights are to be exercised; and
(iv) any other element or document facilitating the location of the data.

Upon receipt of the request to exercise ARCO Rights, ALTEX shall have 15 (fifteen) business days to review, address, and provide the corresponding response. The Company shall communicate its decision through the means indicated in the request or, failing that, through the same means by which the request was submitted.

(G) Remote Means

The Data Subject agrees that:

(i) the Website may include links to third-party websites which, if accessed, will cause the user to leave the Website, and therefore ALTEX assumes no responsibility regarding such third-party websites;

(ii) the Website may include links to social media platforms, in which case the Data Subject acknowledges that by providing any type of information, including personal data, on such platforms, said information may be read, viewed, accessed, retransmitted, and processed by any person, thereby releasing ALTEX from any liability; and

(iii) our systems may collect additional data beyond that provided by the Data Subject, such as browser type, operating system, visited web pages, IP address, etc., through cookies, web beacons, among others. To disable these systems, users must access the “Internet Options” section within the “Tools” menu of their browser.

(H) Closing an Account

Upon closing your account, ALTEX shall remove your personal information from public view as soon as possible, based on account activity and in accordance with applicable laws.

We retain information from closed accounts in order to comply with the law, prevent fraud, collect outstanding payments, resolve disputes, troubleshoot Company and Website functionality issues, assist in investigations, enforce our Terms of Use, and take actions permitted by law.

(I) Minors

ALTEX is committed to protecting the privacy of minors who use the Internet. ALTEX does not collect or request information intended to identify minors (under 18 years of age). Should we discover that we possess such information, it shall be deleted as soon as possible.

If you are a minor, please do not attempt to provide personal information through our websites. If you believe ALTEX possesses information regarding a minor under thirteen years of age, please immediately contact us at mmena@grupoaltex.com.

(J) Changes to the Privacy Notice

This Privacy Notice may be modified by the Company as many times as deemed necessary, whether or not requested by competent authorities, in order to remain consistent with applicable legal provisions.

In the event of any change to this Privacy Notice, the Company may send an email to the account registered on the Website or provided through other in-person or electronic data collection methods and/or publish a visible notice on the Website.

(K) Disputes

In the event of any dispute arising from this Privacy Notice, the parties shall first attempt to resolve it through good-faith negotiations and may be assisted by a professional mediator.

If, after a maximum period of 30 business days of negotiation, the parties fail to reach an agreement, the provisions of the Federal Law on Protection of Personal Data Held by Private Parties shall apply, and the parties accept the intervention that may correspond to the National Institute for Transparency, Access to Information and Personal Data Protection (INAI).

(L) Acceptance of Terms

By accepting this Privacy Notice, the Data Subject waives any other jurisdiction and legislation that may otherwise apply.

This Privacy Notice is governed by Mexican law, and any dispute shall be resolved before the competent Mexican authorities.

This Confidentiality / Privacy Statement is subject to the Terms of Use of the ALTEX Website described above, which constitutes a legal agreement between the User and ALTEX.

If the Data Subject and/or User uses ALTEX services, it means that they have read, understood, and agreed to the terms stated above. If the User does not agree with them, they must not provide any personal information or use ALTEX Website services.
